Senior citizen alleges harassment by UT Police, HC seeks response
The high court has sought a response from UT Senior Superintendent of Police (SSP) Naunihal Singh asking him to explain as to why no action was taken against inspector Diwan Singh, former Station House officer (SHO), Police station, Sector 34, Chandigarh, despite an internal inquiry holding him guilty of harassing a 77-year-old.
An inquiry done by a senior police officer reportedly held Raghubir Rai Dehra guilty of conniving with private persons to illegally grab the possession of a shop belonging to the senior citizen. Despite this, no action has been taken against the inspector and no FIR has been registered against the private persons. Alleging this, Dehra has petitioned the high court seeking directions to the Chandigarh Police to take departmental action against Diwan Singh and register an FIR against the private persons who forcibly occupied the shop, in Sector 32, belonging to the senior citizen.
Dehra, through his counsel, senior lawyer Puneet Bali alleged that he had leased out his shop to an individual for a year. However, the tenant allegedly entered into an agreement, without the knowledge of Dehra, with another person. After the lease ended, the third party allegedly in connivance with the former SHO threatened the senior citizen to hand over the possession to them.
The senior citizen approached senior police officers following which an in-house inquiry was ordered. The 31-page inquiry report clearly states that it was a civil dispute and that the police officer could not have interefered into the civil dispute.
The inquiry report was tabled in the second week of June. Despite a clear and adverse finding against the cop and private individuals, no action has been taken so far. Dehra requested the high court to direct registration of an FIR against the individuals on charges of trespassing and criminal intimidation. He has also pleaded that the possession of his shop be returned to him.
Taking serious note, the high court issued notices to inspector Diwan who is at present posted with the security wing and the private respondents in the case. They have been given three weeks time to furnish their response.
