Police complaint must to get pension of missing govt employee

NEW DELHI: Simplifying the procedures of family pension to legal heir of the deceased or missing pensioner, the government has brought out certain changes in rules that may allow the beneficiaries to get arrears of pension up to Rs 2.5 lakh - 10 times more than the existing limit of Rs 25,000 — after producing "any documentary proof" regarding legal heir of the claimant.

As far as missing pension is concerned, the family members will, however, have to submit a copy ofthe First Information Report (FIR) or any other report such as a Daily Diary or General Diary Entry while applying for the family pension.

"The amount of salary due, leave encashment due and the amount of GPF will be paid to the family in the first instance as per the nominations made by the employee or pensioner on filling of a police report and submission of an indemnity bond," said an official.

In case of death of a pensioner, all money payable to the pensioner on account of pension are payable to nominee of the deceased pensioner. In the absence of any valid nomination made by the pensioner, the arrears of h/his pension are paid to the legal heir.

However, dependants of some pensioners expressed difficulties in obtaining the legal heir certificates and represented that the necessity of production of legal heir certificates may be waived where the amount of arrears payable is small.

Considering this, the government had in 1985 had allowed payment of lifetime arrears of pension on the basis of any documentary proof regarding the relationship of the claimant if the gross amount of arrears does not exceed Rs 25,000. "Now, this limit has been extended to Rs 2.5 lakh," said an official.

Similarly, the accounts officer was earlier authorized to make the payment on h/his own authority if the gross amount did not exceed Rs 5,000 and the case represented no peculiar features. "This limit has now been extended to Rs 50,000," said the official.
